This Privacy Policy is incorporated by reference into the ServiceHome End User License Agreement and Terms of Use (https://www.servicehome.com/terms-of-service) (the “EULA”). The term “ServiceHome,” “we,” and “us” includes Scorpion Design, LLCand our affiliates and subsidiaries. The Privacy Policy explains how ServiceHome may collect, use and disclose information we obtain through the Service. All other terms not defined herein will have the meanings set forth in the EULA.

THE SERVICE COLLECTS YOUR INFORMATION

Personal Information Collection. You must register to use the Service. To register, you will need to provide information, such as your name and email address. If you are a Customer, you must also provide your address and create a password. If you are a Provider, you must also provide your address, phone number and create a password.

Social Sign-On. You may sign in through a third party using your credentials for that third party’s website. If you do, then we collect information about you. For example, we may collect the information you have made publicly available on the third party website. The information we receive from these third parties is governed by the third parties’ privacy policies, and you should review these third parties’ privacy policies to learn about the privacy and data security practices.

Using the Service. We collect information you post on or through the Service. For example, when you interact with other users by submitting a review or chatting with other users, the Service will collect the information you provide in such submissions.

Making and Receiving Payments. When you make or receive payments through the Service, you will need to provide information to our third-party service providers, such as your credit card or bank account number.

Location Information from Your Mobile Device. We may collect and store your location information if you enable your mobile device to send it to us. Collection of this information may improve the provision of the Service.

Other Device Information. We receive information from devices you use to connect to or the Service. The information we receive from your device may include IP address, operating system, and other device information.

Cookies, Automatic Data Collection, and Related Technologies. The Service collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics.

When you visit the Service, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Service may not work properly.

HOW SERVICEHOME USES YOUR INFORMATION

Providing the Service. We use the information we collect to provide, personalize, and improve the Service.

Internal and Service-Related Usage. We use information, including unique identifiers, for internal and service-related purposes, such as data analytics

Communications. We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance.

Marketing. We may use information about you to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.

Aggregate Data. We may anonymize and aggregate data collected through the Service and use it for any purpose.

SERVICEHOME MAY DISCLOSE YOUR INFORMATION

Facilitating Projects. In order to facilitate Projects, we must provide the Provider with some information about a Client, including display name and requested service location, which may be a personal or business address. Clients will receive a Provider’s display name, profile information, and agreed service location, which may be a personal or business address.

We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the Service, including our payment processors.

Displaying to Other Users. Any User Content you post on the Service may be displayed on the Service and viewable to other users and the general public. We are not responsible for the privacy practices of the other users who will view and use the posted information.

Aggregate Data. We may share or disclose anonymized and aggregated data collected through the Service.

Social Networking and Other Websites. The Service may allow you to share information with social networking websites, such as Instagram. We do not share your information with them unless you direct the Service to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites.

As Required By Law and Similar Disclosures. We may disclose your information and User Content if we believe doing so is required or appropriate to: (i) comply with law enforcement requests or legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) enforce this Privacy Policy, our EULA, or any other agreements, or (iv) protect yours’, ours’ or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. The use of your information following any of the foregoing events should be governed by the provisions of this Privacy Policy in effect at the time such information was collected.

With Your Consent. We may also disclose your information with your permission.

CHOICES YOU HAVE WITH YOUR INFORMATION

Opt-out. You can unsubscribe from promotional emails from us via the unsubscribe link provided in the email. Even if you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us.

Changes to your information. If you would like to update or correct any information that you have provided to us through your use of the Service, please send an email to servicehome@scorpion.co

DO NOT TRACK

Some web browsers incorporate a “Do Not Track” feature. Because there is not yet an accepted standard for how to respond to Do Not Track signals, our website does not currently respond to such signals.

SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us.

CHILDREN’S PRIVACY

We do not knowingly collect, maintain, or use information from children under 13 years of age, and no part of the Service is directed to children under the age of 13. If you learn that your child has provided us with information without your consent, you may alert us at servicehome@scorpion.co. If we learn that we have collected any information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.

INTERNATIONAL USERS

If you are visiting from a country outside of the United States, please note that you are agreeing to the transfer and processing of your information in the United States. By providing your information you consent to any transfer and processing in accordance with this Policy.

California Consumer Protection Act (“CCPA”).

To the extent the CCPA applies to Client, Scorpion agrees that it shall not retain, use, or disclose any Personal Information of Consumers for any purpose other than performing under the Agreement. Scorpion agrees that this prohibits Scorpion from retaining, using, or disclosing such Personal Information outside the direct business relationship between Client and Scorpion. Scorpion agrees not to sell Personal Information of Consumers for any purpose. Scorpion further agrees to delete a Consumer’s Personal Information within the statutory timeframe from Scorpion’s servers upon request by authorized agents’ of Client. Scorpion certifies that it understands these restrictions and the requirements of the CCPA, and that it intends to comply. Scorpion shall indemnify Client and its officers, directors, shareholders, employees, agents, members, and independent contractors, and hold them harmless against all claims, demands, losses, damages (including punitive damages), costs, suits, judgments, penalties, expenses (including reasonable attorneys’ fees and amounts paid in settlement or compromise) and liabilities of any kind, whether or not ultimately determined to be meritorious for which they are held liable, or which they incur in any litigation, proceeding, or enforcement action as a result of or arising out of Scorpion’s breach of this Addendum. Notices. Notices under this Addendum shall be delivered to Scorpion only via email to DataPrivacy@Scorpion.co. Notices sent via email will be effective as of the date and time stamp recorded on the sent email.

“Consumer” means any natural person who is in the state of California for other than a temporary or transitory purpose, or domiciled in the state of California and outside the state for a temporary or transitory purpose, whose Personal Information is shared with Scorpion by Client for purposes of providing services to Client pursuant to the Agreement.

“Personal Information” means: (i) Identifiers - real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, social security number, driver’s license number, passport number, and other similar identifiers; (ii) personal information described in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e), which, in addition to the identifiers described above, includes – signature, physical characteristics or description, state ID card number, insurance policy number, education, employment or employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information; (iii) characteristics of protected classifications under California or Federal law – race, religion, gender, national origin, sexual orientation; (iv) commercial information – records of personal property, products or services purchased, obtained, or considered, other purchasing or consuming histories or tendencies; (v) biometric Information; (vi) internet or other electronic network activity information - browsing history, search history, or information regarding a Consumer’s interaction with a website, application, or advertisement; (vii) geolocation data; (viii) audio, electronic, visual, thermal, olfactory, or similar information; (ix) professional or employment-related information; (x) education information; and, (xi) Inferences drawn from any information in these categories to create a profile about a Consumer reflecting the Consumer’s preferences, characteristics, psychological trends, preferences, predispositions, behavior attitudes, intelligence, abilities, and aptitudes. Personal Information does not include information that is publicly available or that is deidentified or aggregate consumer information that cannot reasonably identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular consumer so long as Scorpion has technical safeguards against reidentification, implements business practices prohibiting reidentification and preventing inadvertent release of the deidentified information, and makes no attempt to reidentify the information.

CHANGES TO OUR PRIVACY POLICY AND PRACTICES

We may make changes to this Privacy Policy from time to time. If we do revise this Privacy Policy, we will update the “Effective Date” at the top of this Privacy Policy. In the event that the changes materially alter your rights or obligations under this Privacy Policy, we will make reasonable efforts to notify you of the change. For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the Service for the first time after such material changes are made. Your continued use of the Service constitutes your acceptance of the terms of the Privacy Policy as amended or revised by us from time to time.
